Ethical Obligations & Data Security Best Practices for Bankruptcy 1.0 Professional Conduct Hours Part 1 will consist of a discussion of the requirements of Rules 1.1 [Comment 8], 1.4, 1.6, 1.15 and 5.3 of the Ohio Rules of Professional Conduct as they implicate technological competence, communication and handling of confidential information. ABA Formal Opinions 477 (May 11, 2017) and 483 (October 17, 2018) will be addressed, as will the implications of Ohio Revised Code Section 1349.19 for lawyers. Part 2 will consist of a discussion by bankruptcy court staff describing problems observed by them involving potential client data security issues for practitioners in the court and suggested best practices for being alert to and avoiding them. Part 3 will consists of an overview of cybersecurity insurance for lawyers.
