General Information On Filing Requests for Referral To Fee Arbitration With The Toledo Bar Association

If a Grievance and a Request for Referral to Fee Arbitration are filed and the Toledo Bar Association Grievance Committee determines that the grievance against a lawyer is primarily a dispute over fees, or if a Request for Referral to Fee Arbitration is filed without a grievance, the Grievance Committee may elect to refer the matter to the Fee Arbitration Committee for further proceedings. Whether a matter is referred to the Fee Arbitration Committee is determined by the facts of the case and the amount in dispute.

If the Grievance Committee elects to refer the dispute to the Fee Arbitration Committee the client will be required to sign a consent and the matter will be set for arbitration. Arbitration is an alternative to the parties to a legal fee dispute, short of litigation. The decision of the Fee Arbitration panel is binding, and there is no right of appeal. There is no cost for this service. If the lawyer has not filed suit for fees, fee arbitration is mandatory if the client consents. If a lawsuit was filed concerning the fee dispute before a grievance was filed, arbitration is possible only if all parties agree.

If the Grievance Committee determines that the facts are not supportive of the client’s Request for Referral to Fee Arbitration, or if the amount in dispute is in the range of $200.00, the Request will be denied.
