Emily Puffenberger Simpson serves as General Counsel at the Lucas County Juvenile Court and has dedicated her career to public service. In addition to completing a federal clerkship, she has served in key roles at the Ohio Secretary of State’s Office, Colorado Judicial Branch, U.S. Department of Health & Human Services, and U.S. Department of Education. Emily earned her J.D., cum laude, from The University of Toledo College of Law, where she served as an executive editor on law review, and as a Legal Research and Writing Teaching Assistant. She is licensed to practice law in both Ohio and Colorado.

Description: This presentation provides an overview of Ohio Rule of Superintendence 48 and its role in guiding guardian ad litem (GAL) practice in Ohio custody and parental-rights cases. It explains that the Rules of Superintendence are generally treated by courts as administrative guidelines rather than enforceable substantive rights, while emphasizing that Rule 48 still establishes important minimum standards for GAL investigations, professionalism, objectivity, and best-interest recommendations. The presentation highlights the need for careful documentation, especially when investigative steps cannot be completed, and discusses how courts typically evaluate GAL complaints. It concludes with practical guidance.
