The fiduciary obligations that leaders owe charities has not changed. But COVID-19 has changed the way that some of these obligations are being fulfilled. This workshop, presented by staff members of the Ohio Attorney General's Charitable Law Section, will review those fiduciary duties and discuss the ways that some leaders have been responding to the challenges of the pandemic. The speakers will also address the statutory framework used to handle charitable transactions, dissolutions and mergers, as well as charitable use of restricted gifts.
Statutory provisions that will be reviewed include Ohio Revised Code Sections 109, 1716, 2915 and 1702. Several provisions of the Ohio Administrative Code will be referenced, as we as several regulations handled by the IRS. Discussion will center on fiduciary obligations and the duties of care, loyalty, compliance and the duty to maintain accounts.
