Amended Public Notice of Temporarily Filing Procedures and Closing of Divisional Offices to the General Public

Pursuant to Third Amended General Order 20-03 Temporary Filing Procedures, the courthouses and intake desks are CLOSED and no face-to-face assistance is available. These temporary procedures terminate on October 30, 2020, unless terminated or extended by separate Order of the Court.

Registered Case Management/Electronic Case Filing (CM/ECF) users must continue to file electronically. Filers who are not represented by counsel and do not have access to CM/ECF may submit documents for filing through U.S. Mail or e-mail. Documents should be sent to the appropriate Court location address as follows:

Toledo Municipal Court to Continue Restricted Access

Update Posted July 28, 2020

TOLEDO MUNICIPAL COURT TO CONTINUE RESTRICTED ACCESS 

Toledo Municipal Court has issued an order updating restricted operations and access for the members of the public. 

In order to ensure the safety of court staff and citizens before the Court and in accord with JE 20-COVID-001, the Court is vacating 20-COVID-013 only as it relates to opening the Court building to all members of the public effective August 3, 2020. 

Access will continue to be restricted to persons with scheduled cases or appointments, or who have business with the Clerk’s Office.

This continued restricted access is made in order to minimize the public health risk to the public and staff while ensuring the continuance of essential court functions.

When the emergency subsides, the Court shall enter an order declaring an end to the judicial emergency and a resumption of normal operations.  


Oregon Municipal Court

Update Posted July 22, 2020

Court costs were increased as of June 1, 2020.  Please reference the Court's Local Rules for new filing fees.

August 1, 2020. Face coverings will continue to be required of the public, court employees coming in direct contact with the public, and other individuals seeking to enter the building. Individuals will continue to be required to have their temperature taken prior to entering the courthouse. Anyone with a temperature over 100 degrees will be asked to leave and their case will be rescheduled.

Access to the building will remain limited to persons with scheduled cases, warrants, court filings or making payments. Face coverings are required to enter the building.

 Fines and Costs: Payment of fines, costs and fees are encouraged to be paid by mail, online at www.oregoncourtpayments.com or by calling 419-324-2039.

When the emergency subsides, the Court shall enter an order declaring an end to the emergency and a resumption of normal operations.

Local Court Updates

U.S. District Court for the Northern District of Ohio - Closed to the Public, Official Business Authorized
  • ALL COURTHOUSES OF THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF OHIO, SHALL BE CLOSED TO THE PUBLIC UNTIL MAY 1, 2020.  ONLY PERSONS HAVING OFFICIAL BUSINESS AUTHORIZED BY THIS GENERAL ORDER OR BY A PRESIDING JUDGE, INCLUDING CREDENTIALED MEDIA, MAY ENTER COURTHOUSE PROPERTY.  THIS APPLIES TO ALL DIVISIONAL LOCATIONS
  • CIVIL CASES: 
    1. No jury trial will be commenced before May 1, 2020.  Any trial dates currently scheduled during that period are vacated.
    2. All scheduled civil matters will be conducted by telephone or video conference unless otherwise canceled by the assigned judge.  This applies to motion hearings, case management conferences, pretrial conferences, settlement conferences, and Alternative Dispute Resolution (ADR) proceedings.   
  •  CRIMINAL CASES: 
    Due to the Court’s reduced ability to obtain an adequate spectrum of jurors and the effect of the public health recommendations on the availability of counsel and court staff to be present in the courtroom, the time period of the continuances implemented by the General Order will be excluded under Speedy Trial Act, as the Court specifically finds that the ends of justice served by ordering the continuances outweigh the interest of the public and any defendant’s right to a speedy trial pursuant to 18 U.S.C. Section 3161(h)(7)(A).  Accordingly, 
    1. No jury trial will be commenced before May 1, 2020.  Any trial dates currently scheduled during that period are vacated. 
    2. Initial appearances, arraignments, and detention hearings will proceed and will be conducted by telephone or video conference where practicable. 
    3. Criminal pretrials with defense counsel and United States attorneys may proceed, but by telephone only. 
    4. Criminal sentencings are postponed and will not proceed unless the defendant is in custody and (a) the presiding judge determines that an imposed sentence would be equal to or less than the time in which the defendant has been in pretrial custody; or (b) where the presiding judge determines that there is a liberty interest, public safety, or other case-specific compelling reason that makes an immediate sentencing necessary. 
    5. Change of plea hearings will not proceed.  To the extent possible and with the agreement of the defendant, after filing a notice to enter an open guilty plea or plea agreement signed by the defendant and/or defense counsel, the taking of the plea of guilty and the sentencing shall be consolidated for a date after the presentence report has been prepared. 
    6. All grand jury proceedings are suspended until May 1, 2020, unless absolutely necessary and with the approval of the Chief Judge. 
    7. All in-person re-entry court sessions are suspended until May 1, 2020. 
    8. All petty offense (CVB) proceedings are suspended until May 1, 2020. 
    9. Consistent with recently implemented procedures, all detainees, upon arrival at a courthouse and before appearance in court, will undergo screening for fever and other symptoms of COVID-19 contamination.  Such screening will be administered by and/or at the direction of the United States Marshals Service (USMS) or its agencies or designees.  The presiding judge must be notified if the detainee exhibits risk factors and will have the discretion to order the detainee returned to the facility from which they came.   
  • OTHER: 
    1. All mass public gatherings are suspended, including, but not limited to, group tours and visits, moot courts and mock trials, bar group meetings, seminars, and naturalization ceremonies. 
    2. All employees of the District Court are directed to telework through May 1, 2020, except when directed by their supervisors/judges to report to the courthouse to perform essential functions. 
    3. The Clerk’s Office intake windows will be closed.  Electronic filings may still be made through the CM/ECF system.  For those without access to CM/ECF, documents may be submitted by mail, or in the event of an emergency, may be submitted by email to:  EmergencyFiling@ohnd.uscourts.gov.  All emergency filings must include an email address and phone number where the filer may be reached.  Filings submitted by mail and email will be processed each business day.  Mail will be received and processed each 
    4. business day.  Clerk’s Office staff will be available by telephone from 9:00 a.m. to 4:00 p.m. each business day as follows:

    Payments by attorneys using the CM/ECF system will be processed via credit card utilizing Pay.gov.  Payments by check or money order will be accepted by mail and will be processed when received. 
     
    Cash payments will not be accepted during this period.  Any pro se litigant filing a case via email who cannot secure a check or money order should submit his or her filing by mail, and the Clerk’s Office will send a notice directing payment be submitted after courthouses reopen.  
     
    The Court will vacate or amend this Amended General Order no later than May 1, 2020.

U.S. Bankruptcy Court for the Northern District of Ohio at Toledo - Closed to the General Public, Official Business Authorized

In response to the pandemic spread of COVID-19, the court has issued General Order 20-03 Temporary Filing Procedures, effective 11:59 p.m. on March 23, 2020, signed by Chief Judge Mary Ann Whipple on March 23, 2020. General Order 20-03 closes divisional offices, including the intake desks to the general public. The General Order has been posted on the website here on 3/23/2020.
 

The court has issued Amended General Order 20-02 Temporary Modification of Requirement to Obtain Original Signatures from Persons for Electronic Filings and Amended General Order 20-03 Temporary Filing Procedures, signed by Chief Judge Mary Ann Whipple on May 4, 2020. Both Amended General Orders 20-02 and 20-03 are amended to modify that these orders terminate on June 12, 2020, unless extended or terminated by separate Order of the Court.  All divisional offices, including the intake desks to the general public remain closed through June 12, 2020.

Sixth District Court of Appeals 
  • The court will maintain and continue its daily, and essential operations for the duration of the Tolling Order and will continue to monitor its pending caseload. 
  • Briefs and motions must, as always, be filed with the appropriate clerk of court, and the clerks have modified their in-person hours of operation and filing procedures to accommodate alternatives to in-person filing. Specific filing questions should be directed to the respective clerk's office. 
  • The court encourages attorneys and parties to comply with pre-existing court deadlines, to the extent the parties and attorneys are able to do so while maintaining their safety and observing social distancing practices, issued prior to the Tolling Order.  
  • The court encourages the preparation of trial transcripts by court reporters, and filing with the clerk, during the period of the Tolling order to the extent the court reporters are able to do so while maintaining their safety and observing social distancing practices. 
  • The court encourages the clerks of court to file trial court records and supplemental records during the period of the Tolling Order to the extent the clerks of court are able to do so while maintaining their safety, the safety of their employees, and while observing social distancing practices. 
  • All filing deadlines have been "tolled" until the date the period of emergency ends or July 30, 2020, whichever is sooner, pursuant to the Tolling Order. The court will continue to decide case that have been fully briefed and are ready to be submitted. 
  • The court will also handle cases as usual unless a party moves for an extension of time pursuant to the Tolling Order. 
  • The court will order that a case remain active if it is related to a situation that requires immediate attention. The court's determination of whether a case necessitates immediate attention shall be decided on a case-by-case basis. 
  • In determining whether the facts and circumstances of a particular case require immediate attention, the court will consider factors, including, but not limited to, the type of case before the court, the specific order being appealed from, the date the notice of appeal was filed, the length of transcripts, if any, the number of extensions, which were granted prior to the issuance of the Tolling Order, and the alternatives to in-person access provided by the clerk of courts. 
  • In the event the court issues an order, necessitated by the court's determination of a need for immediate attention, which a party believes the party is unable to safely comply with, tat party shall file a motion advising the court of the party's respective safety concerns. 
  • The court will strive to be uniform in its conformance with the language, intent, and its application of the Tolling Order. 
Lucas County Court of Common Pleas - General Division - Open with Restrictions

The Lucas County Courthouse will offer reduced hours starting Monday, April 6, 2020 and lasting until such time that the agencies within the courthouse resume normal hours after the COVID-19 pandemic.  The Courthouse will be in operation from 8:30 am – 12:00 pm, Monday through Friday

A Duties Judge will be available each workday from 8:30 AM until 12:00 PM. Contact the Lucas County Court Administrator's Office for the identity and location of the Duties Judge.

This order does not apply or impact the Domestic Relations, Juvenile, or Probate Court divisions.

Be further advised that each individual Court has the discretion to only be available by phone and/or email in the morning hours as well. Concerned parties should contact each individual Court at the contact information options listed below.

  •  Judge G. Cook’s arraignment docket will be held on Wednesday mornings, 9:00AM.

  •  Judge S. Cook’s arraignment docket remains on Wednesday morning, 9:00AM.

  •  Judge L. Jennings’s arraignment docket is moved to Wednesday mornings, 9:00AM.

Administrative Judge of the Lucas County Court of Common Pleas, General Division, in consultation with the other Judges of the General Division, hereby issues the following TEMPORARY ORDERS; (Note:  these orders do not apply or impact the Domestic Relations, Juvenile, or Probate Court Divisions) Civil Proceedings:

  • No jurors will be summoned for civil trials through May 4, 2020. Parties may proceed with a bench trial after consultation and approval of the assigned Judge.
  • The parties are ORDERED to continue with good faith efforts to resolve all issues by the originally assigned trial date.
  • All settlement pre-trials are ORDERED to be conducted by teleconferencing on the scheduled settlement pre-trial date. Parties should contact the assigned Judge’s civil bailiff to coordinate conferencing efforts.
  • If litigants have a trial date set between the date of this Order and May 4, 2020, and no other scheduled hearing date before the trial date, all parties are ORDERED to contact the appropriate civil bailiff no later than seven (7) days before the scheduled trial date.
  • If litigants have any other (non-trial) hearing scheduled prior to May 4, 2020 they are instructed to contact the appropriate civil bailiff no later than seven (7) days before the scheduled hearing date. Parties should expect their hearing to be rescheduled.
  • All initial pre-trials are ORDERED to be conducted by telephone or the court will issue a scheduling order to the parties by its own Order.
  • Discovery should continue as normal. Depositions are recommended to be conducted by video link when possible, but left to the agreement of the parties. If the parties cannot agree, they are ORDERED to present this disagreement to the assigned Judge, with the expectation that the court will grant a continuance of the deposition if there is no agreement by the parties, unless circumstances warrant otherwise.
  • All civil filings not currently exempted by Local Rule 10 are encouraged to be E-filed.
  • Hearings regarding Temporary Restraining Orders will still be adjudicated and Cognovite notes will still be processed.
  • Proceedings in Aid will continue to be processed, but all debtor exams are hereby continued until after May 4, 2020.  Contact the assigned judge as to the new exam date.
  • All cases currently scheduled for mediation between the date of this Order and May 4, 2020 are hereby canceled, subject to being rescheduled.  Parties are instructed to contact the assigned judge for further instructions.

    Criminal Proceedings:
  • No jurors will be summoned for out-of-custody defendants and their trial date UNLESS there are speedy trial issues. The Lucas County Prosecutor’s Office, through its assigned assistant prosecutors, is responsible for accurate calculation of the remaining time left on each individual case regarding speedy trial deadlines.
  • If a defendant's speedy trial rights expire less than fifteen (15) days after the scheduled trial date, both defense counsel and the assigned assistant prosecutor are ORDERED to appear before the assigned Judge for an attorney-only pre-trial to discuss relevant dates as soon as practicable, but in no event less than seven (7) days before the scheduled trial date. All parties are ORDERED to continue good faith discussions working toward resolution of all issues.

  • The trial dates of all defendants held in-custody or out on bond are ORDERED MAINTAINED. The assigned lawyers are ORDERED to appear before the designated Judge for an attorney-only pre-trial as soon as practicable to discuss scheduling. Be advised that if speedy trial constraints allow, the presently set trial date may be continued.

  • The public health emergency identified herein may be considered to be a finding of good cause for the granting of a continuance of jury trials, court trials, and hearings as deemed necessary by each Judge on a case-by-case basis.

  • Court proceedings are open to the public. Victims, defendants and all parties are permitted by law to have friends, family, and the press present for these proceedings. However, because of the declared State of Emergency, it is appropriate and strongly encouraged that the lawyers alig

    ned with these parties discourage the appearance in court of nonessential observers. Any non-party exhibiting signs of illness is subject to being removed from the courthouse.

    The court is in the process of increasing its capacity to have video hearings between inmates held in the Lucas County Corrections Center and the court. This is an ongoing process and attorneys will be updated as to details. When fully operational it is the ORDER of the court that official court proceedings between inmates in the Lucas County Corrections Center and the court may be conducted by video conferencing and on the record.

    All payments ordered in criminal cases (court costs, restitution) are stayed until May 4, 2020.  Individuals are prohibited from coming to court to make in-person payments.

    Lucas County Court of Common Pleas - Domestic Relations - Open with Restrictions
    Judge Lewandowski will be hearing dissolution's and settled divorce cases by phone or Zoom (or some other conferencing system) in the upcoming weeks. Click here for the complete update on how this will work. 
    ALL HEARINGS, including complaints for divorce, petitions for dissolution, motion hearings, pre-trials, other conferences or appearances, and court counseling appointments are STAYED until May 4, 2020 unless extended by further order of this court. 
    New petitions for DOMESTIC VIOLENCE PROTECTION ORDERS will be accepted and heard Monday through Friday, between the date of filling of this Order and May 4, 2020 are hereby ordered NOT TO APPEAR. 
    All hearings in the above-mentioned time frame are continued. Court personnel will contact all affected parties and/or attorneys with a new date and further instructions. Please, do not call the court concerning a new hearing date. 
    The court continues to explore alternate hearing and appearance methods with the resources available.

    • As of March 13, 2020 all visitation with youth is suspended.
    • Any outside volunteers, groups, etc., entering either of the facilities have also been suspended.

    Juvenile Clerk’s Office:
    As of March 13, 2020, the Juvenile Clerk’s Office is rescheduling/postponing some hearings.  If you have a scheduled hearing at Juvenile Court between March 13, 2020 and June 1, 2020 and it is postponed, you will receive a notice with a new hearing date in the mail. 
    • Any cases being postponed are those in which statutory time frames and public safety are not an issue.
    • The following hearings will NOT be postponed at this time: o Dependency, Neglect and Abuses cases filed by Lucas County Children Services; o Detention Hearings; o Domestic Violence Hearings; o Community Detention Hearings.

    • The Lucas County Juvenile Clerk’s Office is no longer accepting child support payments until further notice.  If you need to make a payment on your child support please check with the Lucas County Child Support Enforcement Agency (LCCSEA).  Information on how to make an online payment and/or where you can mail a payment can be found on the Lucas County website at https://www.co.lucas.oh.us/661/Payments 
    Probation Department:
    • Daily operations will proceed as usual. Officers will be available via phone during business hours.
    • Officers will maintain regular contact with parents regarding court involved youth via phone.
    • Home visits with clients are suspended until further notice.
    • Office visits are suspended until further notice.
    • Officers may make contact with youth and parents within the community (i.e. programming, prosocial activities, community centers, etc.) Please speak with your child’s officer for more information.
    • Interviews/assessments/reports will be conducted over the phone with youth and parents.
    • Officers will make contact with assigned youth in JDC or YTC via phone.
    • Parents should speak with your child’s Officer regarding court hearings, resource staffings, and other programming held at the court.
    • If your child is in a treatment home please speak with your child’s Officer for information regarding visits and contact. 
    Workforce Development Program:
    • Please contact Amanda O’Neill, Workforce Development Coordinator, at (419) 213-6658 to determine if your child will be scheduled to work. 
    Misdemeanor Services: 
    • Misdemeanor Services will follow the same protocol as the Probation Department.
    • Daily operations will proceed as usual. 
    • Officers will be available via phone during regular business hours. 
    Assessment Center:
    • The Assessment Center will be opened during regular business hours and will continue to process cases as usual.
    • Assessment Center staff are available by phone to answer any questions. Please call (419) 213-6670 for more information. 
    Family Violence Intervention Program (FVIP):
    • Staff with the Family Violence Intervention Program will be available during regular business hours. 
    • The Step-Up Program will continue via video conferencing with families. 
    • Domestic Violence Mediations will not take place at this time.  Family Safety Plans will be put into place.

     Programming:
    • At this time the Bike Program, and Youth Advocate Program will proceed as usual.  Please contact your child’s assigned Probation Officer for more information.  Update: 3/18/2020 
    Mediation Department:
    • Daily Domestic Violence Mediations will not take place at this time.
    • The Truancy Prevention through Mediation Program at Toledo Public Schools will continue as usual.  Once Toledo Public Schools re-open regularly, scheduled mediations on Wednesdays will resume.
    • Civil Mediations that are held at the Lucas County Child Support Enforcement Agency (LCCSEA) will continue as scheduled as long as LCCSEA is open.
    • Civil Mediations; Dependency, Neglect & Abuse Mediations; Truancy Mediations; and Contributing Mediations held at Lucas County Juvenile Court in the Juvenile Justice Center Building are being postponed until after June 1, 2020.  Parties will receive notice of new date in the mail.

     Court Appointed Special Advocate (CASA) Department:
    • The CASA Department will remain operations and CASA Volunteers will continue to serve our community’s abused and neglected children.
    • The CASA Courage Awards originally scheduled to take placed on April 1, 2020 have been postponed and will take place on October 6, 2020 at 5:30 pm at the Hilton Garden Inn Toledo Perrysburg.
    • The CASA Pre-Service Training originally scheduled to begin on May 20, 2020 has been postponed and will now begin on June 3, 2020.
    • All CASA In-Service Training sessions have been canceled until June 1, 2020. 
    Aramark Food Services Update for JDC and YTC Meal Services for youth and staff:  
    • Aramark shall continue to observe correct and frequent cleaning and sanitizing of food service equipment and all kitchen surfaces to prevent the spread of illness amongst both employees and customers. 
    • Additional prevention measures include: ensuring all employees continue to follow Aramark’s Cleaning and Sanitation Standards and Procedures, cleaning and sanitizing objects and surfaces, especially those frequently touched with bare hands; and ensuring proper cleaning of “high touch surfaces” such as tables, handrails, and door handles that can easily spread germs between employees and guests.

    Lucas County Probate Division 
    Effective April 6th 2020, The Lucas County Probate Court will be in operation from 8:30AM to 12:00PM, Monday through Friday, until such time that the court resumes normal hours after the COVID-19 emergency.
    The court has no walk-in capacity at this time. The court is only conducting scheduled hearings and conferences. No other visitors will be permitted. All contact with the court related to a probate matter shall be by telephone at (419) 213-4775. Court personnel will advise you how to proceed.


    Marriage License Procedures:

    The Lucas County Probate Court, under presiding Judge Jack R. Puffenberger, will offer online marriage license applications starting Tuesday, May 26, 2020 for Lucas County residents. The court is continuing its policy of not issuing licenses in person at the court due to COVID-19. This will allow the public to be served in an efficient and safe manner.  The online marriage license application and required procedures will be available via the website at www.lucas-co-probate-ct.org.  Payments can be made via debit or credit cards and after a license is issued it will be mailed out to the applicants. 

    Certified copies of marriage licenses will also be available to order online beginning Tuesday, May 26, 2020.   

    If you were previously issued a license that expired after March 16, 2020 it will be valid for 60 days past the Governor’s stay at home orders being lifted.

    Toledo Municipal Court - Open with Restrictions
    Continuing Operations 
    The Court will continue to perform essential functions but will limit hearings to in custody defendants only, through May 15, 2020 or until otherwise so ordered. All felony and misdemeanor non custody cases will be continued to after May 15, 2020. On any individual case, a prosecutor, defense counsel, defendant or alleged victim may petition the Court to have a hearing go forward regardless of custody status.
    Beginning April 28, 2020, face coverings are required of the public, court employees, and all other individuals who enter or remain in the building. Entry will be denied without a face covering.

    Beginning May 18, 2020, the Court will begin to phase in regular court operations according to the following schedule below. Face coverings are required of the public, court employees, and other individuals seeking to enter the building.

    May 18, 2020. Courthouse will open to include scheduled CRA (Felony) CRB (Criminal) and TRC (Operating Under the Influence) cases. This includes pretrials and trials on individual judge dockets and the 9:00 out of custody arraignment docket for CRA, CRB and TRC only. Face coverings are required to enter the building.

    Duties will open to warrants only (open and bench warrants). Any other Duties matters must be addressed by filing a motion with the Court. Other than warrants, access to the Courthouse is strictly limited to persons (attorney, defendant, victim, witness) with scheduled cases.

    The Judges mandatory docket rotation will return to normal. Courtroom 3 will continue to hear all (misdemeanor and felony) in custody cases by video from the jail until otherwise ordered. Courtroom 3 will hear all felonies (in-custody and out-of-custody). Courtroom 4 will hear all out of custody misdemeanor CRB and TRC arraignments. This procedure will continue until further notice. Duties is limited to warrants only.

    Start times for scheduled assigned cases on individual Judges dockets will be staggered: Cases with private attorneys will be scheduled for 9:00am; cases with public defenders will be scheduled for 10:00am; and Pro Se cases will be scheduled for 11:00am.

    Face Coverings. Face Coverings are required to enter the building. They must cover your mouth and nose. When you are in a Courtroom on the record, you will need to speak slowly and loudly to ensure that you can be understood.
    Social Distancing. We have indicated where people can sit, and where they can stand and move. Please follow these guidelines.
    Day Porter and Sanitation. The Court has hired an additional staff member to assist in maintaining the high levels of cleaning and sanitizing that are expected in areas open to the public.
    Building Entry. You must have a scheduled court date or appointment to enter the building. All individuals are screened at the door. Entry may take longer than normal because of this screening. You may only enter the building a half hour before your scheduled court date or appointment. You may not enter earlier. Individuals with open or bench warrants may also enter the building to turn themselves in on the pending warrant.
    Limited Operations. Between May 18 and May 29, the Court is conducting first appearances (also called arraignments) and scheduled hearings for cases with a prefix of CRA, CRB and TRC. If you have questions about when your court date is scheduled, please check your case on the Clerk of Court website at https://www.tmc-clerk.com/case-information/ or call the Court.
    Emergency Motion. The form to request a continuance due to illness is at https://www.tmc-clerk.com/…/emergency-motion-to-reschedule-…. Please include any proof or documentation to support the motion with the fax or email. Please check the clerk’s website to see the status of your motion or call the Clerk’s office.
    Victims/Witnesses with Questions. Victims and witnesses with questions should contact the City or County Prosecutor’s Office. Witnesses with questions about felony cases should contact the Lucas County Prosecutors Office at (419) 213-4700 from 8:00 a.m. to Noon. Victims with questions about felony cases should contact the Lucas County Victim-Witness Assistance Program at (419) 213-4591. All other victims and witnesses with questions should contact the City of Toledo Prosecutor’s Office at (419) 245-1975 from 8:00 a.m. to 4:30 p.m.

    June 1, 2020. Courthouse will open to hearings on civil cases and Small Claims. The courthouse will also open to payment of fines, costs, and fees and court filings. Access to the building is strictly limited to persons with scheduled cases, court filings or making payment on fines, costs and fees. Duties is limited to warrants only. Face coverings are required to enter the building.

    July 1, 2020. Courthouse is open to hearings on TRD (Traffic) cases including the afternoon traffic arraignment docket. Access to the building is strictly limited to persons with scheduled cases, court filings or making payment on fines, costs and fees. Duties is limited to warrants only.     August 3, 2020. Courthouse is open to the public. Duties Court is limited to warrants only. The need for face coverings will be determined by the public health recommendations at that time.

    Fines and Costs: All fine, fees, and costs that are due between March 11, 2020 and June 1, 2020 are stayed an additional 90 days. Payments of fines, costs, and fees prior to June 1, 2020 can only be made via online payment or by phone.

    Filings: Individuals who wish to file with the Clerk of Court must follow the electronic filing process that can be found on the Clerk of Court’s website, until June 1, 2020.

    When the emergency subsides, the Court shall enter an order declaring an end to the judicial emergency and a resumption of normal operations.

    Toledo Municipal Court issued an order on Sunday, March 15 declaring a temporary judicial emergency in response to the COVID-19 pandemic. Starting Friday, March 20, 2020, Toledo Municipal Court limited hearings to only those cases where the defendant is in jail. All other cases will be scheduled after May 4, 2020. This extends the prior date of March 31st.
    The Toledo Municipal Court will do all things necessary to ensure the continued orderly and efficient administration of justice during this ongoing health emergency. On any individual case, a prosecutor, defendant, defense counsel or alleged victim may petition the Court electronically to have a hearing go forward regardless of whether the defendant is currently in jail. Forms are available at http://tmc.toledomunicipalcourt.org/ and may be filed by fax or email.

    Victims and witnesses may receive subpoenas and be required to report to the Court for trials where the defendant is being held in custody, or if the Court grants an exception to the general closure. Victims and witnesses with questions should contact the City or County Prosecutor’s Office. Individuals with questions about felony cases should contact the Lucas County Prosecutors Office at (419) 213-4700 from 8:00 a.m. to 4:30 p.m. All other victims and witnesses with questions should contact the City of Toledo Prosecutor’s Office at (419) 245-1975 from 8:00 a.m. to 4:30 p.m. Victims who desire to go forward with motions for temporary protection orders should appear or contact the Prosecutor’s Office. Victims who wish to have their cases heard despite the emergency closure must contact the proper Prosecutor’s Office or their case will be continued until after the temporary judicial emergency.
    Entry to the building on these matters is limited to the defendant, attorney, victim and subpoenaed witnesses or by appointment.

    All current scheduled setouts/lockouts will be stayed 8 days from the currently scheduled date.
    All currently scheduled eviction hearings will be continued after May 30, 2020.

  • Maumee Municipal Court - Open with Restrictions
    Attorneys are encouraged to pre-try cases by telephone with the Prosecutor’s Office for any non-jailable offenses, either traffic and/or criminal. Defendant’s personal appearance for nonviolent offenses is WAIVED.
    Most unclassified drivers license infractions will be considered waiverable and able to be resolved through the traffic violations bureau without a mandatory court appearance.
    Defendant’s appearance at their first pre-trial for non-violent offenses is waived so long as th

    ey have posted bond and are not in custody.
    The Court will allow any non-jailable offense to be pleaded by Agreed Entry.
    All individuals required to make payments on restitution, fines and costs are encouraged to utilize the website or call our call center (1- 800-300-8007) to make a payment.
    Oregon Municipal Court - Closed to the Public with Exceptions 
    Any individual with a court date scheduled in the month of April 2020 for an unclassified or minor misdemeanor traffic offense will be given an automatic six (6) week continuance.  There is no need to report and a summons will be sent to each individual with a  new court date to appear. Court dates have been entered and available by looking up your case on our website;

    Any individual with a payment owed for fine and costs due between March 9, 2020 and May 31, 2020 will be given an automatic ninety (90) day continuance of the date due.  Updated due dates have been entered;

    The public is encouraged to make payments via mail, online at www.oregoncourtpaymentscom  or by telephone at 419-324-2039. It is asked that the public refrain from making payments in person at the courthouse;

    The courthouse is closed to the public except for those individuals with a case scheduled before the court on that date, a victim on a case or witnesses subpoenaed to appear for a case schedules on that date;

    Cell phones are to remain in vehicles;

    All probationers should contact their probation officer by telephone only;

    The court is still processing new civil filings and garnishments. All civil filings requiring payment of a filing fee are to be filed by mail; and

    Any filing not requiring a filing fee can be filed by mail, fax at 419-698-7013 or email at court@oregonmunicipalcourt.us.

     

    Sylvania Municipal Court - Open with Restrictions
    The Sylvania Municipal Court will be closed to the public except for any individual (defendant, witness, victim, attorney, or law enforcement officer) with a scheduled case. All persons appearing for scheduled Court hearings must practice social distancing protocols. Ill persons will not be permitted in the building. 
    Felony and in-custody cases will continue as scheduled. 
    Effective March 18, 2020, all traffic (TRD) cases will be rescheduled to a date after May 1, 2020. This includes all arraignments, pre-trials, and trials.  
    Effective March 18, 2020, all Operating a Vehicle Under the Influence (TRC) cases, with the exception of arraignments, will be rescheduled to a date after May 1, 2020.  
    Effective March 18, 2020, all non-violent criminal cases will be rescheduled to a date after June 1, 2020. All criminal cases involving violent crimes, including but not limited to Domestic Violence, Assault, Menacing, Child Endangerment, Temporary Protection Order Violations and any Sexually Oriented Offenses, will proceed as scheduled. 
    Effective March 18, 2020, all emergency motion hearings including but not limited to Motions for Temporary Protection Orders will continue as scheduled. Emergency motions and protection order requests must be filed via e-mail at clerk@sylvaniacourt.com or by fax at (419) 885-8987. 
    Effective March 18, 2020, all Probation Violation hearings will be rescheduled to a date after May 1, 2020. All probation office appointments, including pre-sentence investigation interviews and scheduled meetings with probation officers will be rescheduled until a date after May 1, 2020.  
    All fines, fees, and costs that are due between March 12, 2020 and May 1, 2020 shall be continued an additional 90 days from the original due date. If the new due date should fall over a weekend or holiday, it will be continued to the next business day. Effective immediately, payment of fines, costs, and fees can only be made on-line.  
    Effective March 18, 2020, individuals with open-warrants must contact the Court via telephone to schedule an appearance date to address the warrant. No unscheduled appearances are permitted.  
    Effective March 18, 2020, all Jury Trials will be rescheduled until a date after May 1, 2020. 
    Effective March 18, 2020, all civil proceedings, except emergency actions, are suspended for a period of 60 days. Civil proceedings may be conducted via telephone at the discretion of the Judge. Any filings should be made via e-mail at clerk@sylvaniacourt.com or by fax at (419) 885-8987. 
    Effective March 18, 2020, the Court will temporarily suspend certain local rules to permit individuals or attorneys to file motions for continuance in Criminal, Traffic and Civil matters scheduled for trial or hearing.     If a defendant’s speedy trial rights expire less than 15 days after a scheduled trial date, defense counsel and the prosecutor are ordered to contact the Court to schedule a telephone pre-trial. All parties should continue to engage in discovery and work in good faith on the resolution of pre-trial issues via telephone and through electronic communications.

    Wood County Court of Common Pleas - Open with Restrictions
    All Local Rules of this Court may be temporarily adapted, modified or suspended to allow Court flexibility, within Constitutional limits, in response to the public health emergency.

    The security policies and procedures of the Court may be temporarily amended or supplemented to protect public health safety while maintaining essential court functions.

    The Court’s Employee Handbook provisions may be temporarily adjusted to maintain essential court operations and functions.

    The Court authorizes, on a case-by-case basis unless otherwise approved, the use of audiovisual devices and technologies for Court actions and proceedings.

    The public health emergency may be considered to be a finding of good cause for any purposes, including continuances deemed necessary by assigned Judges, on a case-by-case basis.

    The Court will have the lawful authority, within constitutional limits, to do and direct to be done all things necessary to ensure the orderly and efficient administration of justice for the duration of the declared public health emergency and such time after the declaration is ended deemed necessary by this Court.

    For all hearings, the Court shall be notified prior to the scheduled hearing if any of the following apply to any party, attorney or witness: has travelled outside of the United States and returned to the United States within 21 days prior to the scheduled hearing; has been exposed to the Covid-19 virus or anyone infected with the Covid-19 virus within 21 days prior to the scheduled hearing;  or has been quarantined, isolated or otherwise restricted by any health department, director of health, or similar entity. 

    All pre-trials that are not designated as a final pre-trial, unless otherwise specifically ordered by the Judge or Magistrate handling the case, shall be conducted by telephone (conference call).  The parties, unless appearing pro se or otherwise approved by the Court in advance, shall NOT participate in the telephone pre-trial, but shall be available to counsel either in person (but not listening in on the pre-trial) or by telephone.  All final pre-trials, if a trial date has already been scheduled, will be addressed on a case-by-case basis. In criminal cases defense counsel shall, prior to the pre-trial occurring, have had appropriate contact with their client and shall have reviewed with the defendant all discovery provided by the State of Ohio up to that time. 

    For all pre-trials other than final pre-trials in cases where the Defendant is currently incarcerated, the Defendant shall not, unless specifically ordered by the assigned Judge, be transported to the Court by the Wood County Sheriff.  Counsel for the Defendant shall meet with the Defendant prior to the pre-trial with the Court and again within 24 hours following the pre-trial with the Court.

    The Court may make such modifications and authorizations in any manner deemed reasonable by the Court and need not follow formal processes for modification of Rules of Court and Rules of Procedure, and shall provide notification of any modifications and authorizations in such manner as may be deemed reasonable by this Court, including but not limited to posting same to the website maintained by the Court or Clerk of Courts, posting same in public spaces of the Wood County Courthouse, and by providing same to parties or members of the Bar by mail or email.

    This Order shall remain in full force and effect until such time as same is modified or rescinded by the undersigned Judges

    Perrysburg Municipal Court
    The Perrysburg Municipal Court, Wood County Ohio makes the following Orders in alignment with the ongoing response to the COVID-19 health crisis and in accordance with Administrative Order 20-04, the Court issues the following temporary orders:

    Continuing Operations – All felony and in-custody cases will continue as scheduled.

    Traffic TRD Cases – Effective Wednesday, March 25th, 2020, all traffic cases will be cancelled and reset after May 17th, 2020. This includes all arraignments, pretrial conferences, pleas, motions, and trials on all TRD designated cases. Traffic probation violation hearings will be cancelled and reset.

    OVI/TRC cases – Effective Wednesday, March 25th, 2020, all TRC designated cases, with the exception of arraignments, will be cancelled and reset. TRC designated cases set for probation violation hearings will be cancelled and reset.

    Jury Trials – No Jury Trials will take place until after May 17th, 2020.

    Misdemeanor Criminal Cases – Effective Wednesday, March 25th, 2020, all non-violent cases scheduled through May 15th, 2020 will be cancelled and reset. The following case types will proceed as scheduled:

    Domestic Violence, Assault, Child Endangering, Child Enticement, Aggravated Menacing, Unlawful Restraint, Menacing, Menacing by Stalking, Violations of TPO, Telephone Harassment, Vehicular Homicide, and any attempt, complicity or conspiracy to commit any of the forgoing offenses. Any Sexually Oriented Offenses, including Attempted Importuning, Sexual Imposition, Unlawful Sexual Conduct with a Minor, Voyeurism, Attempted Illegal Use of a Minor in Nudity Oriented Material or Performance, Attempted Child Enticement with Sexual Motivation, Attempted Pandering Obscenity, Menacing by Stalking with Sexual Motivation, Unlawful Restraint with Sexual Motivation, and any attempt, complicity or conspiracy to commit any of the forgoing offenses.

    Probation Reporting – All probation reporting shall take place by telephone unless specifically ordered by probation or the Court.
